These Terms of Service (“Terms”) govern your access to and use of the website located at sparkoflife.org (the “Site”), and any related content, services, products, events, programs, registrations, and communications offered by Spark of Life (the “Organization,” “Spark of Life,” “we,” “us,” or “our”), a nonprofit organization based in Nashville, Tennessee, USA.
By accessing or using the Site, purchasing from us, registering for a retreat, booking coaching, signing up for emails, donating, or otherwise engaging with Spark of Life, you agree to these Terms.
If you do not agree, do not use the Site or services.

We may update these Terms from time to time. Changes become effective when posted on the Site with an updated “Last Updated” date. Your continued use of the Site after changes are posted means you accept the revised Terms.

4) Eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase services, register for retreats, or donate unless a parent/legal guardian registers, consents, and assumes responsibility where applicable.
5) What We Provide
Spark of Life may offer:
In-person grief retreats and events
Coaching sessions (individual and/or group)
Digital products and online courses (including through third-party platforms)
Educational content via video, audio, email, and written materials
Donations and fundraising opportunities
Offerings may change without notice.
6) Educational Nature + Important Disclaimers
Spark of Life provides education, coaching, and support related to grief and loss. We are not a medical, psychiatric, or emergency service.
Not medical or mental health treatment. Our services do not replace care from licensed professionals. If you are experiencing a medical or mental health emergency, or are in danger of harming yourself or others, call 911 or contact local emergency services immediately.
No guarantees. Grief is personal, and results vary. We do not promise specific outcomes.
7) Retreats, Events, and In-Person Programs
7.1 Registration and Participation
Retreat/event registrations are subject to availability and completion of required registration steps. We may decline or cancel a registration if necessary for safety, policy compliance, capacity, eligibility, or operational reasons.
7.2 Separate Participation Terms / Waiver
For retreats/events, you may be required to agree to additional documents such as:
a Retreat Participation Agreement
an Assumption of Risk and Release of Liability waiver
a medical/emergency authorization
a photo/video release
These additional documents are incorporated by reference and will apply to your participation.
7.3 Travel, Lodging, and Personal Responsibility
Unless clearly stated otherwise in writing, you are responsible for your own travel arrangements, personal items, and any costs associated with getting to/from the retreat location. You are responsible for complying with venue rules and applicable laws.
7.4 Health, Safety, and Conduct
You agree to behave respectfully and safely. We reserve the right to remove any participant from an event (without refund, where permitted) for behavior that is disruptive, unsafe, threatening, harassing, intoxicated/under the influence (where prohibited), or otherwise harmful to others or the event environment.
8) Coaching Terms
8.1 Scheduling and Attendance
Coaching session scheduling details and availability are provided at booking. You are responsible for showing up on time and prepared.
8.2 No-Show / Late Cancellation
Coaching cancellations, rescheduling, late arrival, and no-show rules are governed by our separate policy: sparkoflife.org/coaching-policy.
8.3 Boundaries and Scope
Coaching is not therapy or crisis intervention. If we believe your needs are outside our scope, we may recommend that you seek care from a licensed professional and/or pause coaching.
9) Digital Products and Online Courses
9.1 Access
If you purchase an online course or digital product, access may be delivered through a third-party platform (for example, Teachable or another learning platform). You are responsible for maintaining access to the email address/account used for purchase.
9.2 License (Personal Use Only)
Unless otherwise stated, purchases grant you a limited, non-exclusive, non-transferable, revocable license to access and use the material for your personal, non-commercial use only.
You may not:
copy, reproduce, distribute, resell, or share login access
record course videos or redistribute materials
create derivative products using our materials
use our materials to train others commercially without written permission
10) Pricing, Payments, and Taxes
Prices are listed on the Site or checkout pages and may change at any time. You authorize us (and our payment processors) to charge the payment method you provide for purchases, subscriptions, deposits, or payment plans you select.
You are responsible for any applicable taxes, duties, or fees unless we explicitly state otherwise.
11) Refunds, Cancellations, and Transfers

If these Terms conflict with the Refund/Cancellation Policy for a specific purchase, the Refund/Cancellation Policy will control for that purchase.
12) Donations (Nonprofit Terms)
12.1 Donation Processing
Donations may be processed through third-party providers. By donating, you authorize the charge to your selected payment method.
12.2 Donation Refunds
Unless otherwise required by law, donations are final and non-refundable. If you believe your donation was made in error, contact us at [email protected] within 7 days and we will review your request.
12.3 Use of Donations
Unless a donation is clearly designated for a specific campaign or restricted purpose on the donation page, donations may be used at the Organization’s discretion to support our mission and operations.
12.4 Tax Matters
We may provide donation acknowledgements/receipts for your records. We do not provide tax advice. Consult your tax professional regarding whether your donation is tax-deductible and to what extent.
13) Communications and Marketing
By signing up for emails, registering, purchasing, donating, or requesting information, you agree that we may contact you about your account, purchases, event logistics, donation acknowledgements, and related Spark of Life updates. You can opt out of promotional emails via the unsubscribe link in our messages.
14) Intellectual Property
The Site and all content—logos, trademarks, videos, audio, downloads, course materials, text, graphics, and other materials—are owned by Spark of Life or its licensors and protected by applicable intellectual property laws.
You may not use our brand assets or content without written permission, except as allowed by law.
15) User Content and Testimonials
If you submit content to us (messages, testimonials, comments, reviews, photos, or other materials), you represent that:
you have the right to submit it, and
it does not infringe others’ rights or violate laws.
You grant Spark of Life a worldwide, royalty-free license to use, reproduce, display, and distribute that content for legitimate organizational purposes (for example, showcasing testimonials), unless you explicitly request in writing that a specific testimonial not be used publicly.
We may edit testimonials for clarity or length while keeping the meaning intact.
16) Prohibited Uses
You agree not to:
violate any laws or regulations
interfere with the Site’s operation or security
attempt unauthorized access to systems or data
scrape, data-mine, or use automated tools without permission
upload viruses or malicious code
harass, threaten, impersonate, or abuse others
use the Site or content for unlawful or commercial purposes without authorization
17) Third-Party Services and Links
The Site may link to third-party sites or use third-party services (payment processors, scheduling tools, webinar platforms, learning platforms). We do not control those services and are not responsible for their content, security, availability, or practices. Your use of third-party services is subject to their terms.
18) Termination
We may suspend or terminate your access to the Site or services if you violate these Terms, misuse our content, or engage in conduct that we determine is harmful to others, our mission, or our operations.
Termination does not affect any rights or obligations that by their nature should survive (including payment obligations, intellectual property protections, disclaimers, limitation of liability, and indemnification).
19) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
We do not warrant that:
the Site will be uninterrupted or error-free
content will be complete, accurate, or always current
any particular emotional, relational, spiritual, or personal outcome will result from participation
20) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARK OF LIFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE [3 / 6 / 12] MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
(Some jurisdictions do not allow certain limitations. In such cases, liability is limited to the fullest extent permitted by applicable law.)
21) Indemnification
You agree to indemnify and hold harmless Spark of Life and its directors, officers, employees, contractors, volunteers, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
your use of the Site or services
your violation of these Terms
your violation of any law or third-party rights
content you submit or actions you take in connection with Spark of Life
22) Governing Law and Venue (Tennessee)
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms, the Site, or the services shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee (Nashville area), and you consent to personal jurisdiction there.

23) Miscellaneous
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver: Failure to enforce a right is not a waiver of that right.
Entire Agreement: These Terms, plus any additional policies you link (Refund Policy, Retreat Participation Terms, etc.), form the entire agreement regarding Site use and purchases.
